Hoje, acionei Desembargadores, através do TRIBUNAL DE SP - SEÇÃO DIREITO PÚBLICO E AUTORIDADES POLÍTICAS para uma questão que está há alguns anos me incomodando, e então, procuramos uma solução ou entendimento, se é que existe outro, para a questão.
Não somos donos da verdade, mas dignos de direitos como todo e qualquer outro cidadão.
Publico a carta que enviei às autoridades competentes:

diferenciado, tornando-se um instrumento efetivo de Justiça, Equidade e Paz Social.



          Venho através desta apresentar duas observações e razões  sobre CESPE E FUNDAÇÃO
CESGRANRIO como Empresas promotoras de Concursos Públicos no Brasil.
Dada a liberdade de estabelecer condições através de Editais, creio que, a fiscalização
deste poder elaborativo, não esteja sendo devidamente arbitrada, seja de quem for tal atribuição,
creio que, pela "simplicidade aparente e inobservância das ocorrências dos eventos por parte
dos candidatos" e do Poder fiscalizador competente.
CESPE ao "exigir" via internet a senha do candidato, no caso específico, candidato
que mudou de Estado, e há algum tempo não enfrentou concursos por essa Empresa,
ao tentar se inscrever fica adstrito ao recebimento de um mail da CESPE a fim de
procedimentos específicos, dos quais dependem sua inscrição.

4º passo, comunicam que enviaram um mail em 48 horas,
e essas 48 horas se passaram.
A data para inscrição se expirou e esse mail nunca chegou.
Concurso é PARA MINHA CIDADE.
Perdi a chance e era para trabalhar em Sorocaba, STM.
Tentei me inscrever para ABIN e o procedimento CESPE está sendo o mesmo, e
se não for pela CESPE não há inscrições.
Há duas semanas atrás, consultei Concursos em Sorocaba, e estava anunciado
que seria publicado Edital da ABIN, eu preciso da isenção de taxas, e depois, o
prazo para requerer isenção estava encerrado, tentei me inscrever, prazo até
final do mês, mas o site do CESPE procedeu da mesma forma com anúncio de
prazo de 48 hora para retornar com mail. (anexos abaixo)
O candidato que se informa, a exemplo, do concurso no sábado, e a inscrição encerra
na segunda ou terça-feira, perde o direito de competir em condições de igualdade.
A CESPE não responde efetiva e eficazmente, percebe-se a falta de controle, e o
atendimento ideal ao candidato que se propões a se inscrever, permitindo a figura
delituosa de prosperar em Crimes de Danos Morais e Materiais.
Foi o que ocorreu comigo, quando busquei um Concurso na cidade na qual resido
com meus filhos, por ser mais viável, por uma questão sociológica que tem trazido
problemas ao nosso país, ideal é que o cidadão se firme em sua cidade, evitando
propensões a problemas sociais, visando uma sociedade contemporânea, evitando
moradores de rua, problemas de moradia, e até mesmo marginalização dos que se
deslocam.
O fato do CESPE não ter respondido minha solicitação, suponho, por não possuir
 recursos que atualizem  dados cadastrais como o CESGRANRIO, apesar de que,
dificultoso esse recadastramento, creio que a cada Concurso, seja através destes
Institutos, Empresas, parte de população, com tendencia a crescimento em número,
está acontecendo de maneira quase "imperceptível" em sendo excluída de participação.
Gosto e uso muito a expressão "camuflagem", expressão militar, quando me
refiro à nossa Carta Magna, Constituição Federal, pelas seguintes razões:
- a cada dia, muito sutilmente, a Ditadura, da qual o país se pensa livre, se manifesta;
- a cada dia, os acontecimentos denotam, uma hermenêutica prática deturpada, mas
"sofismaticamente" justificada pela Constituição Federal.
Esse modus operandi de Instituições de Concursos, comina com práticas codificadas,
e muitos cidadãos não reagem por falta de postulação e ignorantia legis em relação
a causa.
Em perdendo a chance de concurso em sua cidade, qual o tempo ao qual se lança
o cidadão até novas oportunidades, tornando Diplomas uma inutilidade?
Então, aqui acumulamos mais uma questão, pessoas formadas são levadas a
qualquer "trabalho" pelas necessidades econômicas, porque os concursos não
acontecem necessariamente quanto o número de demanda.
Questão econômica?
Questão de falta de identificação com curso em formação?
Percentual de moradores de rua com curso superior, 75% e são de outros estados
e cidades.
Quero, portanto, alegar, defender o ponto de que, pequenas inobservâncias se tornam
grandes pecados capitais, questões pertinentes a ordem Constitucionais e de
Direitos Humanos.
É uma questão de administrar, e tem como resultado, uma "pré-seleção" lançada aos
"interessados futuros candidatos", lançando impedimento ao direito de se inscrever
 em um Concurso Público ou não. Isso é Inconstitucional.
Existem nos Editais esse tipo de pré-seleção? Ou nos procedimentos eletrônicos iniciais?
As Instituições não conhecem os candidatos, ou foram advertidas em proibir alguns em
detrimento a outros, "o poder participar do certame" que vai, com certeza, em caso de aprovação,
concederia a dignificação de  sua vida ou em caso de não aprovação, resultaria experiências e melhores
chances em certames vindouros.
Solicito verificação, tendo em tese pelo ocorrido, se procede que  Instituições, Empresas ou Fundações,
"manipulam" seletivamente, quais critérios, com oportunidades eliminam, desde inscrições, interessados
a se candiatar, esse ou aquele candidato, injustificadamente, devem arcar com o sustento do mesmo, até
o próximo concurso acontecer, inclusive,com isenções devidas . E se "justificadamente", devem apresentar
razões diante da Corte e Tribunais competentes, pois é questão que fere direitos concedidos aos cidadãos,
inclusive, aos que apresentam deficiências, segundo regulam editais e normas jurídicas.
A Fundação CESGRANRIO, DIFICULTA , fazer Logoff do usuário, se morando em outro Estado, observo, rspeitosamente
que, CONTRASTA, dificultam para os que não residem no mesmo Estado, e favorecem o fato negativo dos interessados a
concursar tenham que se deslocar para outros Estados a partir da INSCRIÇÃO ELETRÔNICA, neste parâmetro, observa-se
que tendências são outras, insisto na pré-seleção, tenho curiosidade em relação ao  requisitos seletivos
Adverso ao primeiro contato eletrônico, recadastramento CESGRANRIO, até chegar na etapa  Fale Conosco, exigem foto
do candidato que está se recadastrando, atualizando seus dados, como reserva de segurança.
Verificar a situação de sua inscrição através da página "ACOMPANHAMENTO DE REQUERIMENTO DE INSCRIÇÃO", que
deverá indicar seu pagamento em até no MÁXIMO 4 (quatro) dias, apesar da data de inscrição findar no final do mês;

Objetivo chamar atenção para questões ao abuso psicológico, além do que representam os Eventos Concursos,
ao verificar o Edital:

a partir das páginas 17,18, se encontram as informações decisórias para o candidato.
O candidato, na maioria das vezes, podem acreditar, tem que ler e reler as páginas
com conteúdos extremos, sendo que as exibilidades que indicam se o cidadão está
apto ou não a participar estão ao final dos super e extensos Editais.
A simplificação favorece entendimentos, e a não oportunidade para enganos.
O problema é real, temos conhecido Blogs que orientam candidatos na leitura de
Editais extensos e complicados. Se há orientação, reconhecimento do fato,

E esses canais não são exatos, não referenciam esse abuso juridicamente, desacreditam em providência jurídica,
e pela delonga do processo, preferem se submeter, conseguir passar e empregar.
Dificultar PRÉ-COMPREENSÃO, automaticamente exerce poder seletivo em relação aos
candidatos, e esse quesito não versa em nenhum Edital.
Edital trás texto, Brasil tem comprovadamente sofrido acusações em relação a essa capacidade
interpretativa desenvolvida, desde bancos escolares, Pré-compreensão: toda leitura supõe que o
 leitor entre no texto já com conhecimentos prévios sobre o assunto ou área específica.
Isso significa dizer, por exemplo, que se você pegar um texto do 3º ano do curso de Direito estando
ainda no 1º ano, vai encontrar dificuldades para entender o assunto.
Vamos ilustrar melhor, concursos para candidatos com ensino Fundamental incompleto se difere
quando, no mesmo Edital, se contrata pessoas Graduadas com Formação Superior?
Falta "organização e realismo em condição a nossa nacionalidade",  aqui é Brasil.
É gritante essa situação, exclui e pratica na camuflagem ritos preconceituosos.
Ouso, sugerir, alterações legais quanto aos sites destas Fundações, Institutos, e em acordo
com a realidade nacional, questão educacional brasileira.
Outra questão que alerto, a partir do momento que o candidato se inscreve, a Fundação tem
endereço, mail, dados do candidato, seletivamente, ele pode retirar somente o conteúdo
da área do candidato e enviar por mail, facilitando todo o processo, evitando demandas e
enganos, inclusive enviar a ficha para recursos e outras solicitações.
Eletronicamente, através de programação e baixo custo, pode-se conseguir.

          I hereby present two observations and reasons on CESPE AND FOUNDATION
CESGRANRIO as companies promoting public tenders in Brazil.

on Monday or Tuesday, it loses the right to compete on equal terms.
CESPE does not respond effectively and efficiently, it is perceived the lack of control, and the

This is what happened to me when I searched for a Contest in the city where I live
with my children, because it is more viable, because of a sociological question that has
problems in our country, it is ideal for the citizen to stand firm in his city, avoiding
