O que é e as suas consequências jurídicas.

A alienação parental foi estudada pelo psiquiatra norte-americano Richard Gardner que, em 1985, propôs o termo Síndrome da Alienação Parental (SAP) – também conhecida pela sigla em inglês PAS – para a situação em que a mãe ou o pai induz o filho a romper laços afetivos com o outro genitor através de uma “lavagem cerebral”.
Trata-se de transtorno caracterizado por sintomas gerados a partir de ações de um dos pais que transformam a consciência da criança ou adolescente, na intenção de impedir ou destruir o vínculo entre o filho e o outro pai.
Encontra-se previsto na Lei n.º 12.318/2010, em seu art. 2º:
"Art. 2º Considera-se ato de alienação parental a interferência na formação psicológica da criança ou do adolescente promovida ou induzida por um dos genitores, pelos avós ou pelos que tenham a criança ou adolescente sob a sua autoridade, guarda ou vigilância para que repudie genitor ou que cause prejuízo ao estabelecimento ou à manutenção de vínculos com este."
A alienação parental foi regulada pela Lei n.º 12.318/2010. Além da previsão legal, a proibição quanto à alienação parental tem fundamento constitucional no princípio da paternidade responsável:
"Art. 226. A família, base da sociedade, tem especial proteção do Estado
§ 7º Fundado nos princípios da dignidade da pessoa humana e da paternidade responsável, o planejamento familiar é livre decisão do casal, competindo ao Estado propiciar recursos educacionais e científicos para o exercício desse direito, vedada qualquer forma coercitiva por parte de instituições oficiais ou privadas."
A lei nº 12.318 de 2010 traz vários exemplos do que pode ser considerado alienação parental: realizar campanha de desqualificação da conduta do genitor no exercício da paternidade ou maternidade;dificultar o exercício da autoridade parental;dificultar contato de criança ou adolescente com genitor;dificultar o exercício do direito regulamentado de convivência familiar;omitir deliberadamente a genitor informações pessoais relevantes sobre a criança ou adolescente, inclusive escolares, médicas e alterações de endereço;apresentar falsa denúncia contra genitor, contra familiares deste ou contra avós, para obstar ou dificultar a convivência deles com a criança ou adolescente;mudar o domicílio para local distante, sem justificativa, visando a dificultar a convivência da criança ou adolescente com o outro genitor, com familiares deste ou com avós.
A síndrome da alienação parental (SAP) também é chamada de:
Síndrome da implantação das falsas memórias;
Síndrome de Medeia;
Síndrome dos Órfãos de Pais Vivos;
Síndrome da Mãe Maldosa Associada ao Divórcio;
Reprogramação da criança ou adolescente;
Padrectomia.
ALIENAÇÃO PARENTAL E SUAS CONSEQUÊNCIAS JURÍDICAS
A Lei da alienação parental prevê diversos tipos de punição aos responsáveis pela alienação parental, como por exemplo: advertência; ampliação da convivência familiar em favor do outro genitor; multa em favor do outro genitor; inversão da guarda; suspensão o poder familiar.
Ou seja, quem pratica atos de alienação parental pode até mesmo perder a guarda da criança e o poder familiar, sendo essa a primeira consequência jurídica. Veja-se jurisprudência correlata:
"AGRAVO DE INSTRUMENTO. AÇÃO DE ALIMENTOS CUMULADA COM REGULAMENTAÇÃO DE VISITAS. ALIENAÇÃO PARENTAL. INVERSÃO DA GUARDA.
Evidenciada a prática da alienação parental, correta a decisão que determinou a inversão da guarda do infante, cujas necessidades são melhores atendidas pelo genitor. NEGARAM PROVIMENTO AO RECURSO." (Agravo de Instrumento Nº 70065839755, Oitava Câmara Cível, Tribunal de Justiça do RS, Relator: Alzir Felippe Schmitz, Julgado em 10/09/2015).
É possível ainda a condenação a compensação por danos morais a vítima da alienação parental, seja um dos pais seja a criança, caso sofra danos psicológicos decorrentes desta conduta.
Veja-se jurisprudência correlata:
"APELAÇÃO CÍVEL. AÇÃO INDENIZATÓRIA. ALIENAÇÃO PARENTAL. DANOS MORAIS.
Merece mantida a sentença que determina o pagamento de indenização por danos morais da apelante em relação ao autor, comprovada a prática de alienação parental. Manutenção do quantum indenizatório, uma vez que fixado em respeito aos critérios da razoabilidade e proporcionalidade. Apelação cível desprovida."(Apelação Cível Nº 70073665267, Oitava Câmara Cível, Tribunal de Justiça do RS, Relator: Jorge Luís Dall'Agnol, Julgado em 20/07/2017).
Contudo, a alienação parental não é crime, uma vez que se considerou que a criminalização desta conduta poderia afetar negativamente a criança, havendo, no Estatuto da criança e do adolescente mecanismos punitivos a quem pratica alienação parental.
CONCLUSÃO
Muitos pais não pensam em quão prejudiciais são as atitudes que assumem. Muitas vezes pensam apenas em si próprios, esquecendo que as crianças estão em um estágio muito sensível em que absorvem tudo, bem como que experiências negativas podem deixar vestígios que marcarão seu futuro.
A alienação parental, embora não seja crime, pode gerar a perda da guarda, multa e obrigação de indenização por danos morais ao cônjuge alienado e mesmo a criança, se graves os danos psicológicos.

Parental alienation was studied by the American psychiatrist Richard Gardner who in 1985 proposed the term Parental Alienation Syndrome (PAS) - to the situation where the mother or father induces the child to to break affective ties with the other parent through a "brainwashing."
It is a disorder characterized by symptoms generated by the actions of one of the parents who transform the child's or adolescent's conscience, with the intention of preventing or destroying the bond between the child and the other parent.
It is provided for in Law no. 12.318 / 2010, in its art. 2º:
"Art. 2. The act of parental alienation is considered to be interference in the psychological formation of the child or adolescent promoted or induced by one of the parents, by the grandparents or by those who have the child or adolescent under their authority, custody or supervision to repudiate parent or causing damage to the establishment or the maintenance of links with it. "
Parental alienation was regulated by Law no. 12.318 / 2010. In addition to the legal provision, the prohibition on parental alienation has a constitutional basis on the principle of responsible paternity:
"Art. 226. The family, the basis of society, has special protection of the State
Paragraph 7. Founded on the principles of the dignity of the human person and responsible parenthood, family planning is a free decision of the couple, and it is the responsibility of the State to provide educational and scientific resources for the exercise of this right, which is prohibited by any official or private institutions. "

The parental alienation syndrome (SAP) is also called:

Malignant Mother Syndrome Associated with Divorce;

Paternity.
PARENTAL ALIENATION AND ITS LEGAL CONSEQUENCES
The Parental Alienation Act provides for various types of punishment for those responsible for parental alienation, such as: warning; expansion of family coexistence in favor of the other parent; fine in favor of the other parent; guard reversal; suspension of family power.
